Policies and Procedures

Misdemeanor Convictions

Effective April 13, 2000

The Board of Physical Therapy Examiners adopts the following policy for the evaluation of an applicant with misdemeanor convictions.

A. When an application is received indicating that the applicant has had one or more misdemeanor convictions, the administrator will determine whether the convictions are misdemeanors under South Carolina law. Once the status of each offense has been determined, the administrator will request the applicant to provide the Board with a copy of the applicant's arrest and disposition records from the state in which the misdemeanors occurred.

B. If the arrest record confirms the information provided by the applicant, the administrator may approve the application after consultation with the Investigative Review Committee Board member after the following factors have been considered:

1. age of the applicant when offenses were committed;

2. time lapsed since offenses were committed;

3. the offenses do not constitute a crime of moral turpitude; and

4. the applicant would otherwise be qualified for approval.

C. The Board shall ratify all decisions of the administrator in conjunction with the Investigative Review Committee Board member regarding these licenses.
