Policies and Procedures

Evaluation of Applicant with Felony Conviction

Effective June 12, 1997

The Board of Physical Therapy Examiners adopts the following policy for the evaluation of an applicant with a felony conviction.

The following factors shall be considered by the Board in evaluating an applicant who has had a felony conviction.

1. Classification of Felony.

2. Number of convictions.

3. Time lapse since conviction.

4. Completion of sentence, including probation, public service or restitution where ordered.

5. Age of applicant at time of conviction.

6. Moral turpitude .

7. Relevancy of crime to the practice of physical therapy.

8. History of applicant since conviction.

9. Openness of the applicant and his willingness to provide detailed information to the Board concerning his criminal record.

10. Willingness of applicant to consent to restrictions or special supervision of his license.

11. Current status of all active and inactive physical therapist/physical therapist assistant licenses.

12. Criminal background check by appropriate law enforcement agency.

13. At least three original letters of reference addressed specifically to the Board which attest not only to the applicant's clinical abilities but character, ethics and behavior - things that relate to the event which the conviction is centered around.
